What is the cash register security regulation?

The Cash Register Security Ordinance (KassenSichV) is intended to ensure the security and tamper-proofing of electronic cash register systems. It has been in force since January 1, 2020 and stipulates that all electronic cash register systems must have a certified technical security device (TSE). This is intended to prevent manipulation of the stored data. The aim of the regulation is to curb tax evasion and illicit transactions by storing cash register data in a tamper-proof manner and making it available to the tax office for inspection if required.

In addition to the TSE obligation, the KassenSichV also includes other requirements, including the obligation to issue receipts. This means that a customer must be given a receipt for every transaction. In addition, every POS system must be registered with the tax office and a uniform digital interface (DSFinV-K) must be used for standardized data transmission. When is a POS system mandatory?

A cash register system is mandatory in Germany if a company uses an electronic cash register or a system for the digital recording of business transactions. Since January 1, 2020, the Cash Register Security Ordinance (KassenSichV) stipulates that electronic cash register systems must have a certified technical security device (TSE) to prevent tampering. Companies that continue to use an open cash register are not affected by this regulation, but must still ensure proper accounting.

If smaller companies still work with a so-called open cash register and could keep their books using a simple income statement, a cash register system also offers tangible advantages for them:
